What we collect, and what we do not

eRegX, also referred to as Environmental Regulatory Exchange, is a data and analytics company based in Houston, Texas. We compile environmental regulatory information from public government sources and provide it to environmental consulting professionals.

This policy covers the website at eregx.com. It does not cover any third party website we link to, including websites operated by the Texas Commission on Environmental Quality or the United States Environmental Protection Agency.

We collect only what you enter into a form on this site. We do not require an account, and we do not process payments through this website.

Please do not send us confidential, privileged, or client identifying information. We ask this on our forms and we repeat it here. Email is not a secure channel and we are not equipped to hold material of that kind.

We use Google Analytics to understand how the site is used. Google Analytics places cookies in your browser and collects information including the pages you visit, how long you spend on them, the approximate geographic region derived from your IP address, and the type of device and browser you are using.

We have configured Google Analytics to anonymize IP addresses. We do not use advertising pixels, session recording, heat mapping, or cross site tracking tools.

Google processes this information on its own terms. You can review how Google handles data at policies.google.com/privacy, and you can opt out of Google Analytics entirely using the browser add-on Google provides at tools.google.com/dlpage/gaoptout. Most browsers also allow you to block or delete cookies through their settings.

Our web host records standard server logs, which may include IP addresses and request information, for operational and security purposes.

This section describes information that is not about you as a website visitor, and we state it separately because the distinction matters.

eRegX compiles records about regulated facilities from public government sources, principally the Texas Commission on Environmental Quality and the EPA Enforcement and Compliance History Online system. Those records are published by the agencies themselves and, in some cases, include the names, job titles, business email addresses, and business telephone numbers of individuals listed as facility contacts in regulatory filings.

We did not collect that information from those individuals. We obtained it from government records that are published and publicly available. We provide it to environmental consulting professionals for legitimate business purposes.

We do not market to facility operators. We do not send commercial messages to the contacts in these records, and we do not compete with the consulting firms that serve them.

If you are listed in our facility records and would like your information removed from what we distribute, write to us at the address in section 14 and we will remove it. We cannot remove it from the underlying government records, which remain published by the agencies.

• To improve our data, our products, and this website
• To follow up once about a sample you requested
• To understand aggregate website traffic patterns
• To meet legal obligations and to protect against fraud or misuse

We do not use automated decision making or profiling that produces legal or similarly significant effects.

We share information only with service providers that operate parts of this website and our communications, and only to the extent needed to do that work:

• Google LLC, for website analytics
• Our form processor, which receives and delivers form submissions
• Our email service provider, which delivers our email and newsletters
• Amazon Web Services (AWS), which hosts this website

We may also disclose information where required by law, in response to lawful requests from public authorities, or to establish or defend legal claims.

If eRegX is ever acquired or merges with another company, information may transfer as part of that transaction. We would give notice on this website before that occurred.

• We do not sell, rent, or trade your personal information
• We do not share your information with advertisers or data brokers
• We do not use advertising pixels or cross site tracking
• We do not record your session or track your mouse movements
• We do not send commercial email to facility operators listed in our data
• We do not require you to create an account to receive a sample

Email addresses collected through our forms are kept while we are corresponding with you and for as long as you remain subscribed to anything you asked for. If you unsubscribe or ask us to delete your information, we remove it.

We retain a minimal suppression record after an unsubscribe request, consisting of the email address alone, so that we do not contact you again by mistake.

Google Analytics data is retained for fourteen months, after which Google deletes it under our configured settings.

Email correspondence is retained as part of our ordinary business records.

Regardless of where you live, you may ask us to do any of the following, and we will honor the request:

• Access. Tell you what information we hold about you
• Correct. Fix anything that is wrong
• Delete. Remove your information from our records
• Unsubscribe. Stop sending you email
• Object. Ask us to stop a particular use

Write to us at the address in section 14. We will respond within thirty days. We may need to confirm your identity before acting on a request, which usually means replying from the email address in question.

We do not charge for these requests and we will not treat you differently for making one.

Residents of Texas, California, and other jurisdictions with consumer privacy legislation may have additional statutory rights. We extend the rights listed above to everyone rather than asking you to establish where you live. If you believe we have not handled a request properly, you may also contact the Office of the Attorney General in your state.

Every commercial email we send includes a working unsubscribe mechanism and our postal address, as required by the CAN-SPAM Act. We honor unsubscribe requests promptly, and in all cases within ten business days.

If you request a data sample, we will send the file and follow up once. We will not add you to our newsletter unless you asked for it separately.

Replying with the word STOP to any message from us has the same effect as clicking unsubscribe.

We take reasonable measures to protect the information we hold, including limiting access to it and relying on established service providers for hosting, form handling, and email delivery.

We want to be straightforward rather than reassuring here. No method of transmitting or storing information is completely secure, and we do not claim that ours is. Email in particular travels unencrypted in many circumstances. Please do not send us anything through this website or by email that would cause harm if it were disclosed.

This website is intended for business use by professionals. It is not directed at children, and we do not knowingly collect information from anyone under sixteen. If you believe a child has provided us with information, write to us and we will delete it.

We may update this policy as our practices change. When we do, we will revise the effective date at the top of this page. If a change materially affects how we handle information already collected, we will give notice on this website before it takes effect.
